Terms and Conditions of Sale

The following terms and conditions apply to all orders placed via this website. They do not affect your statutory rights.

1. Our Contract
The goods and services to be provided by Whitchurch Sports are as detailed in the order form completed by the Customer. Full responsibility for any use made of the goods and services shall rest exclusively with the Customer.

2. Prices and Payment
The total cost of the order will be the price of the goods and services ordered. An applicable delivery charge will be added if required. All prices are clearly stated on this website.

We accept payment by cash, cheque and all major switch and credit cards.

Payment must be made before any order is delivered.

3. Delivery
Delivery must be to an address in the United Kingdom. All deliveries must be signed for. Please retain the invoice enclosed with the order. Whitchurch Sports cannot accept responsibility for damage caused to goods during delivery by post.

Products are delivered either by Whitchurch Sports or by post. Deliveries by post are charged at standard Royal Mail rates.

4. Missing, Damaged or Incorrect Orders
Whitchurch Sports tries very hard to ensure that orders are received in pristine condition. In the unlikely event that all of the order is not received, or a good arrives damaged or faulty, please contact Whitchurch Sports within 48 hours of receiving of the order, either by e-mail at enquiries@whitchurch-sports.co.uk or telephone 01948 665733.

5. Returns
Should any goods received be faulty as a result of manufacturing, a free replacement will be delivered upon the return of the goods initially ordered. Should the services be different to that requested, services shall be re-done free of charge.

This provision does not cover or include faults caused by the Customer through accident, neglect, misuse or normal wear and tear.

Any replacement due to a fault or other defect will include free delivery for the replaced items.

6. Intellectual Property
Whitchurch Sports owns the copyright, trademarks and all other intellectual property rights in all material and content of the business, which may be used, copied, published, transmitted or otherwise made available by any other means only for one's own personal, non-commercial use. Any other use or reproduction of the material or content is strictly prohibited.

7. Force Majeure
Neither party shall be liable for any delay or failure to perform its obligations hereunder if and to the extent that such performance is hindered, delayed or prevented by any cause whatsoever outside the reasonable control of that party. However, this clause does not apply to any obligation to make payments of money.

8. Liability
Whitchurch Sports shall use all reasonable care in handling the goods and carrying out the services, and they shall reflect Whitchurch Sports' professional skill and judgement. Whitchurch Sports does not warrant the fitness for purpose of the services nor the accuracy or completeness of the information they contain. Whitchurch Sports shall in no circumstances be liable for any special or consequential loss or damage, including without limitation loss of profits, loss of income or loss of business.

9. Sub-Contracting
Whitchurch Sports may engage subcontractors to carry out any of the services ordered by the Customer, but shall always remain responsible and liable for the performance of all its obligations under the agreement of the order.

10. Law and Arbitration
These terms and conditions and all transactions are governed by English law and are subject to the non-exclusive jurisdiction of the English courts. Whitchurch Sports does not accept amendments to these terms and conditions.

Data protection rights are set out in the Privacy Policy below.

Whitchurch Sports is required by law to notify the Customer that sales can be concluded in English only and that no public filing requirements apply.

This Privacy Policy applies to this website only, owned by Whitchurch Sports, 11A Watergate Street, Whitchurch, Shropshire, SY13 1DP. This Privacy Policy does not apply to other websites linked to the Whitchurch Sports website, which may have their own policies.

This website only collects information about you and your organisation that you type in and submit, in order for Whitchurch Sports to complete and deliver your order. This information shall not be passed on to any other party.
